Subcommittees
At its
March 23, 2005 meeting the Virginia Freedom of Information
Advisory Council (FOIA Council) formed two subcommittees to
study the issues raised by two bills that did not advance
during the 2005 legislative session but were instead referred
by the General Assembly to the FOIA Council for study.
1. PPEA Subcommittee
(HB 2672)
HB
2672 (Delegate Plum) would have amended an existing meeting
exemption to allow for closed meetings to discuss records
exempt from public disclosure relating to the Public-Private
Education Facilities and Infrastructure Act (PPEA). There
is a concern that the current record exemption for PPEA
and PPTA proposals may be used to withhold more records
than are authorized under the current exemption. The Council
appointed a subcommittee consisting of Council members Axselle,
Edwards, and Hallock to examine these issues.

2. Electronic
Meetings Subcommittee (HB 2760)
HB
2760 (Delegate Reese) would have allowed local public bodies
to conduct meetings under FOIA through electronic communication
means (telephone or audio/visual). Currently, only state
public bodies may conduct meetings in this manner. The Council
appointed a subcommittee consisting of Council members Edwards,
Fifer, Miller and Wiley to examine these issues.
