2012
Subcommittees
For
2012, the FOIA Council appointed two new subcommittees to
study current FOIA issues and legislation as detailed in items
numbered 1 and 2 below, and continued the work of the Criminal
Investigative Records Subcommittee from last year, as detailed
in item numbered 3.
1. Parole
Board Subcommittee
The Parole
Board Subcommittee will study HB 397 (Hope), concerning access
to guidance documents used by the Virginia Parole Board, referred
to the FOIA Council by the 2012 Session of the General Assembly.
The Subcommittee consists of Council members Robert Tavenner,
James Schliessmann, and Frosty Landon (Chair).

2. Electronic
Meetings Subcommittee
The Electronic
Meetings Subcommittee will study HB 1105 (Greason) and HB
1149 (Dudenhefer), concerning the conduct of electronic communication
meetings, referred to the FOIA Council by the 2012 Session
of the General Assembly. The Subcommittee consists of Council
members Kathleen Dooley (Chair), Stephanie Hamlett, John Selph,
and George Whitehurst.

3. Criminal
Investigative Records Subcommittee
The
Criminal Investigative Records Subcommittee was first appointed
in 2010 to study SB 711 (Edwards), which was referred to the
Council by the 2010 Session of the General Assembly for study.
The Subcommittee was then reappointed to study SB 1467 (Edwards),
which was referred to the Council by the 2011 Session of the
General Assembly for study. Both SB 1467 and SB 711 would
limit the exemption for criminal investigative or prosecution
records to those investigations or prosecutions that are ongoing.
As a result, criminal investigative and prosecution records
would be open to the public after the ongoing criminal investigation
or prosecution has become final or has been otherwise terminated.
In 2011 the Subcommittee directed staff and stakeholders to
continue studying the various issues relating to access to
criminal investigative records. That work continues into 2012.
The Subcommittee consists of Council members John Selph (Chair),
Sandra Treadway, and James Schliessmann.
