Subcommittees
At its
April 27, 2009 meeting the FOIA Council appointed two subcommittees
to study current FOIA issues and legislation as detailed in
items numbered 1 and 2 below.
1.
Personal Identifying Information Subcommittee
TThe
Personal Identifying Information Subcommittee was initially
formed in 2007 to study nine bills concerning personal identifying
information as well as concerns raised by the online publication
of a list of concealed carry handgun permit holders. The Subcommittee
was continued in 2008 to study seven bills concerning personal
identifying information. The Subcommittee will continue to
study issues regarding access to social security numbers in
2009. Additionally, the 2009 Session of the General Assembly
referred three bills to the FOIA Council that will be studied
by the Subcommittee: SB 880 (Stuart)(which would exempt from
disclosure personal information in certain records of the
Department of Game and Inland Fisheries), HB 2471 (Hugo)(which
would exempt from disclosure salary records of teachers),
and HB 2630 (Crockett-Stark)(which would establish the Law
Enforcement Officers' Privacy Protection Act). The Subcommittee
consists of Council members Senator Houck (Chair), Delegate
Griffith, Malveaux, Spencer, Whitehurst, Wiley, and Treadway.

2. "Public
Records" Subcommittee
The Public
Records Subcommittee was appointed to study HB 2421 (May),
which was referred to the Council by the 2009 Session of the
General Assembly for study. The bill would have clarified
that the definition of public record does not include correspondence,
messages or other records or portions thereof created or received
by a public employee, appointee or officer that relate to
personal matters and do not address public business; however
such records may be disclosed in the discretion of the custodian.
The Subcommittee consists of Council members Craig Fifer (Chair),
Courtney Malveaux, and John Selph.
