2008
Subcommittees
At its
March 31, 2008 meeting the FOIA Council appointed two subcommittees
to study current FOIA issues and legislation as detailed below.
1. Electronic
Meetings Subcommittee
The Electronic
Meetings Subcommittee was initially formed in 2005 to study
issues raised by HB 2760 (Delegate Reese). The Subcommittee
was continued in 2006 to study SB 465 (Senator Edwards) and
again in 2007 to study HB 2293 (Delegate McClellan), HB 2553
(Delegate Ebbin), and SB 1271 (Senator Whipple). The Electronic
Meetings Subcommittee has been continued in 2008 to study
changes made to electronic meetings provisions affecting the
Air and Water Boards of the Department of Environmental Quality
by HB 1332 (Landes)/SB 423 (Puckett), identical bills passed
during the 2008 Regular Session of the General Assembly that
address the permitting process used by these Boards. The Subcommittee
consists of Council members Fifer (Chair), Senator Houck,
Axselle, Landon, Miller, and Selph.

2. Personal
Identifying Information Subcommittee
The Personal
Identifying Information Subcommittee was formed in 2007 to
study nine bills concerning personal identifying information:
HB 2821 (Delegate Sickles), HB 2558 (Delegate Brink), HB 3097
(Delegate Cole)/SB 1106 (Senator Chichester), HB 3118 (Delegate
Carrico)/SB 883 (Senator Deeds), HB 3161 (Delegate D. Marshall)/SB
1404 (Senator Hanger), and SB 819 (Senator Cuccinelli). Additional
concerns arose after the conclusion of the 2007 Session of
the General Assembly regarding the online publication of a
list of concealed carry handgun permit holders. In addition
to continuing its study of access to social security numbers
begun in 2007, the Personal Identifying Information Subcommittee
has been continued in 2008 to study seven bills concerning
personal identifying information: SB 529 (Houck)(concerning
access to concealed carry handgun permits), HB 858 (Ebbin)/SB
647 (Ticer)(providing an exemption for personal information
of donors to museums), HB 1087 (Sickles)(providing a social
security number exemption outside of FOIA for local government
records), HB 1088 (Sickles)(providing a social security number
exemption outside FOIA for Department of Game & Inland
Fisheries records), HB 1096 (Sickles)(establishing the Protection
of Social Security Numbers Act), and HB 1102 (Sickles)(providing
a general FOIA exemption for social security numbers). All
of these bills were referred to the FOIA Council from the
2008 Regular Session of the General Assembly. The Subcommittee
consists of Council members Senator Houck (Chair), Delegate
Griffith, Malveaux, Spencer, Whitehurst, Wiley, and Treadway.

subcommittees to study current FOIA issues as detailed in
items numbered 3 and 4 below.
3. Database
Index Subcommittee
The Database
Index Subcommittee was formed to examine the provisions of
subsection J of § 2.2-3704, which requires state public
bodies to compile an index of their computer databases. There
are concerns that some of the specific requirements may be
confusing, and that there may be compliance difficulties as
a result. The Subcommittee will work with representatives
of the Virginia Information Technologies Agency (VITA) and
the Library of Virginia, as these bodies are charged by the
statute to produce guidelines regarding implementation of
the database index requirement. The Subcommittee consists
of Council members Landon (Chair), Axselle, Spencer, and Treadway.

4. Meeting
Minutes Subcommittee
The Meeting
Minutes Subcommittee was formed to address whether meeting
minutes must be produced in written form, or whether new technologies
allowing other formats and media are sufficient. In particular,
the Subcommittee will examine the use of BoardDocs and other
technologies that allow for publication online of a navigable
audio recording of meetings with document attachments, as
compared to more traditional written minutes. The Subcommittee
consists of Council members Wiley (Chair), Malveaux, Miller,
Selph, and Treadway.
